Mediation can be an efficient way to get through problems during divorce. Mediation is typically less expensive than arbitration or going to trial, and you'll be able to work with a neutral third party who can keep both of you on track.

How do you know if mediation is the right choice?

There are a number of factors that play a role in the decision to go through mediation, but one good sign is if you have a decent relationship with, or at least feel you can work with, the other person. There is little to no point in going through mediation if you can't talk to the other person or listen to what he or she has to say. If there is any kind of abuse in the relationship, it's unlikely that mediation is going to be a good choice. You'll need to be able to communicate clearly to make mediation work.

What if you don't know what you want out of your settlement?

You need to be a confident person who knows what he or she wants. Your attorney can also help you stand up for what you want during these sessions if you need additional support or aren't sure what you should be asking for. Most importantly, if you and your spouse feel you can openly communicate and just need help getting past a few conflicts of interest, mediation is a good choice. It's important that you're willing to listen to what your spouse has to say and vice-versa, so you can get on the same page.
